The United States Patent and Trademark Office has refused to play ball with Major League Baseball’s effort to trademark one of sports’ most well-known phrases.

In a final ruling brief issued Saturday, the agency rejected MLB’s effort to trademark “Play Ball” for use on clothing. MLB sought to secure sweeping ownership of the colloquialism in all clothing contexts, regardless of styling and font. While the USPTO acknowledged the phrase’s baseball roots, officials found its modern use goes beyond sports and is part of common parlance.
