SCOTUS upholds state laws banning biological males from competing in female sports

The Supreme Court of the United States (SCOTUS) issued a decision upholding state laws that ban biological males from participating in female sports.

In the 6-3 ruling, divided by ideological lines and handed down on Tuesday, the court found that states are allowed “to provide separate women’s and men’s sports teams defined by biological sex.”

As the court noted, over the last six years, 27 states have enacted laws reserving “female sports for biological females,” with Tuesday’s ruling having significant national implications.

President Donald Trump hailed the decision as a “BIG WIN” in a Tuesday social media post.

 

“BIG WIN: The United States Supreme Court just RULED AGAINST MEN PLAYING IN WOMEN’S SPORTS. Wow! That takes that ridiculous situation off the table!!!” the president said.

The case centered around state laws in Idaho and West Virginia that prohibit males from playing in female sports, both specifying that “sex is determined by biology.” The court found that the laws did not violate the U.S. Constitution or Title IX, which prohibits sex-based discrimination in education systems funded by the federal government.

The Supreme Court upheld state laws in Idaho and West Virginia banning transgender girls from participating in girls’ and women’s sports in public schools and universities, ruling the measures do not violate the Constitution or Title IX.
